Welcome! Thank you for your interest in Cox Enterprises, Inc. and the other companies within the Cox Enterprises, Inc. corporate family such as Cox Automotive, Inc., Cox Communications, Inc., and their respective affiliates and subsidiaries (collectively “CEI” or “we” or “our” or “us”). We respect your privacy when you use our websites (collectively, the “CEI Sites”). To see the full text, click on the links. This Privacy Policy applies to your use of any CEI Sites that post a link to this Privacy Policy, regardless of how you access or use it. This Privacy Policy should be read in association with our Terms of Use, which governs the CEI Sites.

CEI PRIVACY POLICY

Thank you for visiting one of the CEI Sites that posts a link to this Privacy Policy which is owned or operated by CEI (“we,” “us,” orour”). This Privacy Policy applies to the CEI Sites and does not apply to any affiliate that maintains a separate privacy policy. This Privacy Policy will provide you with information as to how CEI collects, uses, and shares information about you, including the choices CEI offers with respect to that information, and applies to your use of any of the CEI Sites, regardless of how you access or use it. For certain CEI Sites, there may be additional notices about information practices and choices. Please read those additional privacy disclosures to understand how they apply to you.

Please note that Section 5 of this Policy, which describes our collection and use of information also serves as our Notice At Collection for California residents for purposes of the California Consumer Privacy Act (CCPA). 1. PERSONAL INFORMATION WE COLLECT

We collect various Personal Information in connection with offering the CEI Sites. “Personal Information” generally means any information that identifies, relates to, describes, is reasonably capable of being associated with you or could reasonably be linked with you, directly or indirectly. Personal Information does not include publicly available information or information that is deidentified or anonymized consistent with applicable privacy laws.

Depending on how you interact with the CEI Sites, we may collect the following categories of Personal Information about you:

  • Identifiers such as name, nicknames, aliases, contact information including email, phone, and address, User IDs, IP addresses, and device IDs.
  • Internet usage or other electronic network activity information such as browsing history, referring URLs, search history, interactions with advertising links, and mobile application usage device identifiers, device advertising identifiers, mobile network, operating system details, date/time stamps, language preferences, referring URLs, length of visits, anonymous traffic data, pages viewed, browsing history, search history, information regarding interactions with our website or advertisements, and related data.
  • Location data such as your location we infer based on your IP address.

We may also collect information that cannot reasonably be used to infer information about, or otherwise be linked to you (“Deidentified Information”). Deidentified Information is not considered Personal Information. We may use or share Deidentified Information without obligation to you, except as prohibited by applicable law.

2. HOW WE COLLECT PERSONAL INFORMATION

When you use the CEI Sites, we, or Service Providers acting on our behalf, may collect your Personal Information. This generally happens in one of three ways—you provide us with information, we collect information through automated methods, or we collect information from other sources. There are some situations in which it is necessary for us to collect your Personal Information in order to provide a service to you or to meet legal requirements.

A. Information about You that You Provide. You may share certain information when you interact with CEI and/or its Service Providers (defined below). For example, CEI collects information when you use or register for the CEI Sites, subscribe to notifications, participate in promotional activities, express your interests and/or preferences, subscribe to our newsletters or provide feedback, request information, or communicate, use or transact through the CEI Sites. We may also ask for your information for special reasons, such as for research or in surveys. In addition, when you interact with Third-Party Services (defined below), you may be able to provide information to those third parties. For more information on Third-Party Services’ data collection and practices see Section 9. For more information on Service Provider data collection and practices see Section 3.

B. Information Collected Automatically. When you use the CEI Sites, our technology, or that of our Service Providers and/or Third-Party Services, has the ability to automatically collect certain types of information about you.

We may use a variety of methods to automatically collect Personal Information about you (“Tracking Technologies”). These include:

  • Cookies. A cookie is a small text file that is stored on a user’s device for record-keeping purposes. Cookie types that are used on the CEI Sites include session ID cookies or tracking cookies. Cookies may remain on your hard drive for an extended period of time. If you use your browser’s method of blocking or removing cookies, some but not all types of cookies may be deleted and/or blocked and as a result some features, and functionalities of the CEI Sites may not work. The CEI Sites may associate some or all of these types of cookies with your devices.
  • Web Beacons (“Tracking Pixels”). Web beacons are small graphic images, also known as “Internet tags” or “clear gifs,” embedded in web pages and e-mail messages. Web beacons may be used, without limitation, to count the number of visitors to the CEI Sites, to monitor how users navigate the CEI Sites, and to count content views.
  • Embedded Scripts. An embedded script is programming code designed to collect information about your interactions with the CEI Sites. It is temporarily downloaded onto your computer from CEI’s web server, or from a third party with which CEI works and is active only while you are connected to the CEI Sites and deleted or deactivated thereafter.
  • Location Technologies. Geo-filtering, geo-targeting, geo-fencing, and other location-aware technologies locate your general location, or make assumptions about your location, for purposes such as verifying your location and delivering or restricting content based on your location. If you have enabled location-based features on the CEI Sites, your device location may be tracked by us and third parties. The “find all locations” feature offered within our Site, for example, may access and use information about your device location (such as based on IP address, as applicable). Additionally, some of the CEI Sites use information you enter to offer location-based recommendations and the CEI Sites’ content may be personalized based on various information we may have about you to try to provide you with more location-relevant content.
  • Device Recognition Technologies. Technologies, including application of statistical probability to data sets, as well as linking a common unique identifier to different device use (e.g., Facebook ID), which attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user or household).
  • Recording and Tracking Interactions and Usage. Technologies that monitor, and may record, certain of your interactions with the CEI Sites and/or collect and analyze information from your device, such as, without limitation, your operating system, plug-ins, system fonts, and other data, for purposes such as identification, security, fraud prevention, troubleshooting, tracking and/or improving the CEI Sites and customizing or optimizing your experience on the CEI Sites.

Some information about your use of the CEI Sites and certain third-party services may be collected using Tracking Technologies across time and services and used by CEI and third parties for purposes such as to associate different devices you use and deliver relevant ads and/or other content to you on the CEI Sites and certain third-party services. See Section 7 regarding certain choices regarding these activities. CEI is giving you notice of the Tracking Technologies and your choices regarding them explained in Section 7 so that your consent to encountering them is meaningfully informed.

C. Information CEI Collects from Other Sources. CEI may also obtain information about you from other sources, including Service Providers and Third-Party Services, and combine that with other Personal Information.

3. HOW WE USE THE PERSONAL INFORMATION WE OBTAIN

CEI may use information about you, for the purposes described in this Privacy Policy, or otherwise made by us in writing at the point of collection, and not prohibited by applicable law, including, without limitation, the following:

  • Allow you to participate in the features we offer on the CEI Sites;
  • Facilitate, manage, personalize, and improve your online experience;
  • Provide you with notices about your account;
  • Notify you about changes to the CEI Sites;
  • Transact with you, provide services or information you request, deliver content, respond to your comments, questions and requests, serve you content and/or advertising, and send you notices;
  • CEI advertising, marketing and other promotional purposes;
  • Improve the CEI Sites and for any other internal business purposes;
  • Perform data analyses, including market and consumer research, trend analysis, demographic analysis and financial analysis;
  • Fulfill other purposes disclosed at the time you provide your information or otherwise where we are legally permitted or are required to do so;
  • Determine your location and manage digital content rights (e.g., territory restrictions);
  • Prevent and address fraud, breach of policies or terms, and threats of harm;
  • Diagnose and address technical and service problems;
  • Comply with applicable legal requirements and our policies, to fulfill our legal obligations, protect our legal interests or to address legal claims or disputes;
  • Detect security incidents and protect against malicious, deceptive, or illegal activity; and
  • Contact you via telephone or text. We will obtain your consent to contact you when and, in the manner, required by law.
4. INFORMATION WE SHARE WITH THIRD PARTIES

CEI’s sharing of Personal Information is subject to the following:

  • Marketing: Subject to your communications choices explained in Section 7, we may use your Personal Information to send you marketing communications. Absent your consent (which may be by means of opt-in, your election not to opt-out, or a third party interaction described below), CEI will not share your Personal Information with third parties, other than affiliates, for their own direct marketing purposes, except in connection with Corporate Transactions (defined below).
  • Your Disclosure or Consent: As more fully described in Section 9 (Third-Party Content, Third-Party Services, Social Features, Advertising and Analytics), your activities on the CEI Sites may, by their nature, result in the sharing of your Personal Information with third parties and by engaging in these activities you consent to that and further sharing and disclosure to third parties. Such third-party data receipt and collection is subject to the privacy and business practices of that third party, not CEI.

CEI may also share Personal Information about you for any purposes described in this Privacy Policy, or our written statements at the point of collection, and otherwise not prohibited by applicable law, including, without limitation with:

  • Service Providers and Contractors. CEI’s agents, vendors, consultants, contractors, strategic partners, and outside legal counsel (collectively “Service Providers”) may receive, or be given access to, all categories of your Personal Information. Service Providers may use such information for their operational purposes in order to provide their services to us. For more information on choices Service Providers may offer you, see Section 7;
  • Affiliates and Subsidiaries. We may disclose all categories of Personal Information to our affiliates or subsidiaries for purposes consistent with those described in our Privacy Policy, including to provide you better services, to personalize your experience, and marketing and advertising;
  • Government and Enforcement Agencies. We may disclose all categories of Personal Information to law enforcement agencies, and state or federal government agencies for mandatory reporting or to comply with the law, law enforcement or other legal process, and, where permitted, in response to a government request
  • Advertising and Marketing Partners. We may disclose information to better tailor marketing and advertising on the CEI Sites and on third-party platforms.
  • Third Party Partners. We may disclose your information to certain third-party partners such as businesses we think may interest you or businesses that provide part of the services you are using or have requested.
  • Other Entities When Required by Law or to Protect CEI and Others. If CEI believes your actions are inconsistent with CEI’s Terms of Use, user agreements, applicable terms or policies, or to protect the rights, property, life, health, security, and safety of CEI and its employees, the CEI Sites or its users, including you, or any third party.

In addition, CEI may share your Personal Information, in connection with or during negotiations of any proposed or actual financing of our business, or merger, purchase, sale, joint venture, or any other type of acquisition or business combination of all or any portion of CEI assets, or transfer of all or a portion of CEI’s business to another company, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding (“Corporate Transactions”).

5. ADDITIONAL PRIVACY DISCLOSURES

We have disclosed Personal Information in each of the categories listed below to our affiliates and subsidiaries, business partners, service providers, and other third parties, as well as to government entities where required, for our business purposes within the past 12 months.

Please note that we have not necessarily disclosed every type of information listed in a given category. In addition, we have shared Internet usage or other electronic network activity information with advertising and marketing partners for purposes of targeted advertising.

Selling and Sharing Personal Information. We only sell or share the following categories of Personal Information: identifiers, internet or other electronic network activity information, and location data, and will only share or sell this information through our use of cookies and other tracking technologies (such as web beacons) to our analytics and advertising partners for marketing and advertising purposes.

6. YOUR U.S. PRIVACY RIGHTS

Depending on where you live you may have certain rights with respect to your Personal Information. We may choose to extend these rights to you even if we are not required to under applicable law.

To exercise the right to know, right to delete, or right to correct, you may submit a request by clicking here or emailing us at privacy@coxinc.com. Do not send your privacy request or other information via e-mail. We will contact you for further information if necessary. In order to complete your request, you will be required to respond to any follow up inquires we may make, and we may deny your request if you do not do so.

Right to Opt-Out of Share and Sale of Personal Information.

You have the right to opt out of the sale of your Personal Information (specifically: identifiers, internet or other electronic network activity information, and geolocation data) and to request that we do not share your Personal Information (specifically: identifiers, internet or other electronic network activity information, and geolocation data) for cross-context behavioral advertising.

We honor the Global Privacy Control, a browser-based opt-out preference signal turned on via your device browser, in accordance and to the extent required by applicable law. We do not respond to other browser-based signals that do not meet applicable state law requirements, which may include older Do Not Track signals.

To the extent that we “sell” or “share” your Personal Information, you have the right to opt out by:

(1) enabling your opt out preference signal or Global Privacy Control on your browser

(2) opting out of cookies in cookie preference center, or

(3) submitting a request to us, by clicking here.

Right to Know, Delete, and Correct Personal Information.

Any Request to Know, Request to Delete, and Request to Correct you submit to us is subject to an identification and residency verification process (“Verifiable Request”). We will not fulfill your Verifiable Request unless you have provided sufficient information for us to reasonably verify you are the person about whom we collected Personal Information.

If you are unable to provide us with certain information about yourself, we will be unable to verify your identity to fulfill a request to know, delete, or correct. If we do not comply fully with a request, we will explain the reasons in our response.

We will make commercially reasonable efforts to identify Personal Information that we collect, process, store, disclose, and otherwise use and to respond to your requests. We will typically not charge a fee to fully respond to your requests, but we may charge a reasonable fee, or refuse to act upon a request, if your request is excessive, repetitive, unfounded, or overly burdensome.

You may use an authorized agent to submit your request. If you use an authorized agent to submit a request, we may require proof that the agent has been authorized by you to do so, and take other steps permissible under applicable privacy laws, to ensure it is a proper request by an authorized agent.

  1. Right to Know. You have the right to send us a request, no more than twice in a twelve-month period, for any of the following:

    (1) The categories of Personal Information we have collected about you, including:

    1.  The categories of sources from which the Personal Information was collected
    2. Our business or commercial purposes for collecting, selling, or sharing Personal Information
    3. The categories of recipients to which we disclose Personal Information
    4.  The categories of Personal Information that we sold or shared, and for each category identified, the categories of third parties to which we sold or shared that particular category of Personal Information
    5.  The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of third parties to which we disclosed that particular category of Personal Information

    (2) The specific pieces of Personal Information we have collected about you.

  2. Right to Delete. You may request that we delete your Personal Information that we have collected directly from you and are maintaining. Exceptions do apply, including, without limitation, where we need to retain your Personal Information as permitted by applicable law, such as for legal retention requirements, regulatory reasons, to complete a contract with you, or other internal uses of the information that are compatible with the context in which you provided it.
  3. Right to Correct. If you believe that any of your Personal Information, we maintain about you is inaccurate, you have the right to request that we correct that information.
  4. Right to Appeal. Depending on your jurisdiction, you may have the right to appeal our decision regarding a request. You may exercise your rights by submitting a request using this form.
  5. Right to Non-Discrimination and No-Retaliation for the Exercise of Your Privacy Rights. CEI will not discriminate or retaliate against any person for exercising their rights under the applicable state privacy law.

Exceptions and Impacts of Exercising Your Privacy Rights. We will respond within the time period prescribed by applicable law. Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on your state of residence. Please note that you may be located in a jurisdiction where we are not obligated, or are unable, to fulfill a request. In such a case, your request may not be fulfilled.

7. YOUR CHOICES: TRACKING AND COMMUNICATIONS OPTIONS

A. Tracking Technologies Generally. Regular cookies may generally be disabled or removed by tools available as part of most commercial browsers, and in some instances blocked in the future by selecting certain settings. Browsers offer different functionalities and options, so you may need to set them separately. Please be aware that if you disable or remove these technologies, some parts of the CEI Sites may not work and that when you revisit the CEI Sites your ability to limit browser-based Tracking Technologies is subject to your browser settings and limitations.

Your browser settings may allow you to automatically transmit a “Do Not Track” signal to online services you visit. Like many online services, CEI currently does not alter CEI’s practices when CEI receives a “Do Not Track” signal from a visitor’s browser. To find out more about “Do Not Track,” you can visit http://www.allaboutdnt.com, but CEI is not responsible for the completeness or accuracy of this third party information.

Some third parties, however, may offer you choices regarding their Tracking Technologies. CEI is not responsible for the completeness or accuracy of this tool or third-party choice notices or mechanisms. For specific information on some of the choice options offered by third-party analytics and advertising providers, see the next section. We may offer tools in connection with the CEI Sites that allow you to exercise certain preferences regarding cookies and other Tracking Technologies associated with the CEI Sites.

B. Analytics and Advertising Tracking Technologies. You may exercise choices regarding the use of cookies from Google Analytics by going to https://tools.google.com/dlpage/gaoptout or downloading the Google Analytics Opt-out Browser Add-on. You may opt out of Facebook Custom Audience by logging into your Facebook account and changing your privacy or advertising settings as per Facebook’s opt-out instructions. You may also use your Facebook account settings to unlink your Facebook account from the Site.

CEI may use Google Analytics or other Service Providers for analytics services. These analytics services may use cookies and other Tracking Technologies to help CEI analyze the CEI Sites’ users and how they use the CEI Sites. Information generated by these services (e.g., your IP address and other Usage Information) may be transmitted to and stored by these Service Providers on servers in the U.S. (or elsewhere) and these Service Providers may use this information for purposes such as evaluating your use of the CEI Sites, compiling statistic reports on the CEI Sites’ activity, and providing other services relating to the CEI Sites activity and other Internet usage.

CEI may engage and work with other third parties to serve advertisements on the CEI Sites and/or on third-party services. Some of these ads may be tailored to your interests based on your browsing of the CEI Sites and elsewhere on the Internet, which may include use of location and/or cross-device data, sometimes referred to as “interest-based advertising” and “online behavioral advertising”, which may include sending you an ad on a third-party service after you have left the CEI Sites (i.e., “retargeting”).

C. Communications. You can opt out of receiving certain promotional communications (emails or text messaging) from CEI at any time either by following the instructions provided in emails to click on the unsubscribe link or by changing your marketing communication preferences by logging into your account. Please note that your opt-out is limited to the e-mail address or phone number used and will not affect subsequent subscriptions. If you opt-out of only certain communications, other subscription communications may continue. If you would like to completely deactivate your account, please contact us at privacy@coxinc.com.

Please note, however, that if you deactivate your account, you will not receive any newsletters from us, and you will not be able to participate in any of our contests, sweepstakes, or other promotions. Even if you opt out of receiving promotional communications, CEI may, subject to applicable law, continue to send you non-promotional communications, such as those about your account, transactions, servicing, CEI’s ongoing business relations, or communications related to administrative notices or any communications relevant to your use of the CEI Sites, including communications in the event of a data security event.

8. SWEEPSTAKES, CONTESTS, AND PROMOTIONS

CEI may offer sweepstakes, contests, and other promotions (each, a “Promotion”), including Promotions jointly sponsored or offered by third parties, which may require submitting Personal Information. If you voluntarily choose to enter a Promotion, your information, including PI, may be disclosed to CEI, co-sponsors, Service Providers, and other third parties, including for administrative purposes and as required by law (e.g., on a winners list). By entering, you are agreeing to the official rules that govern that Promotion, which may include consent to additional or differing data practices from those contained in this Privacy Policy. Please review those rules carefully.

9. THIRD-PARTY CONTENT, THIRD-PARTY SERVICES, SOCIAL FEATURES, ADVERTISING AND ANALYTICS

The CEI Sites may include hyperlinks to, or include on or in connection with the CEI Sites (e.g., apps, plug-ins, application programming interfaces (“API”), and software development kits (“SDK”)), websites, locations, platforms, applications or services operated by third parties (“Third-Party Service(s)”). These Third-Party Services may use their own cookies, web beacons, and other Tracking Technology to independently collect information about you and may solicit PII from you.

Certain functionalities on the CEI Sites permit interactions that you initiate between the CEI Sites and certain Third-Party Services, such as third-party social networks (“Social Features”). If you post information on a third-party service that references the CEI Sites (e.g., by using a hashtag associated with the CEI in a tweet or status update), your post may be used on or in connection with the CEI Sites or otherwise by CEI. Also, both CEI and the third party may have access to certain information about you and your use of the CEI Sites and any Third-Party Service.

10. RETENTION OF PERSONAL INFORMATION

Except as otherwise permitted or required by applicable law or regulation, we will only retain your Personal Information (which includes the categories of Personal Information set forth in the charts above) for as long as necessary to fulfill the purposes we Collected it for, as required to satisfy any legal, obligations, or as necessary to resolve disputes. To determine the appropriate retention period for Personal Information, we consider applicable legal requirements, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes we Process your Personal Information for, and whether we can achieve those purposes through other means. For certain types of Personal Information, we will only maintain it for a limited duration.

11. DATA SECURITY AND MONITORING

CEI takes reasonable measures to protect your Personal Information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. Nevertheless, transmission via the Internet and online digital storage are not completely secure and CEI does not guarantee the security of your information collected through the CEI Sites.

To help protect you and others, CEI and its Service Providers may (but make no commitment to) monitor use of the CEI Sites, and may collect and use related information including Personal Information to, without limitation, identify fraudulent activities and transactions; prevent abuse of, and investigate and/or seek prosecution for, any potential threats to or misuse of the CEI Sites; ensure compliance with the Terms of Use and this Privacy Policy; investigate violations of or enforce these documents; improve the CEI Sites and your CEI Sites experiences, and to protect the rights and property of CEI, third parties, and other users. Monitoring may result in the collection, recording, and analysis of online activity or communications through the CEI Sites. If you do not consent to these conditions, you must discontinue your use of the CEI Sites.

12. INTERNATIONAL TRANSFERS

CEI is based in the U.S. and the information CEI and its Service Providers collect is governed by U.S. law. If you are located in the European Union (EU), European Economic Area (EEA), and/or Switzerland, please note that CEI does not intend to offer goods and services (including the CEI Sites) to EU, EEA, or Swiss individuals. If you are accessing the CEI Sites from outside of the U.S., please be aware that information collected through the CEI Sites may be transferred to, processed, stored, and used in the U.S. Data protection laws in the U.S. may be different from those of your country of residence. Your use of the CEI Sites or provision of any information therefore constitutes your consent to the transfer to and from, processing, usage, sharing, and storage of your information, including PII, in the U.S. as set forth in this Privacy Policy.

13. CHILDREN’S PRIVACY

The CEI Sites are intended for a general audience and not directed to children less than 16 years of age. CEI does not intend to collect “personal information” as defined by the U.S. Children’s Online Privacy Protection Act (“COPPA”) (“Children’s Personal Information”) in a manner that is not permitted by COPPA. If you are under 16, do not provide any Personal Information to us. If you believe your child may have provided us with their Personal Information, you can contact us at privacy@coxinc.com and we will delete their Personal Information to the extent required by law.

14. CHANGES TO THIS PRIVACY POLICY

We reserve the right to change this Privacy Policy prospectively effective upon the posting of the revised Privacy Policy and your use of the CEI Sites indicates your consent to the privacy policy posted at the time of use. You are responsible for periodically visiting the CEI Sites and reviewing this Privacy Statement to check for any changes. However, we will not treat your previously collected Personal Information, to the extent it is not collected under the new privacy policy, in a manner materially different than represented at the time it was collected without your consent. To the extent any provision of this Privacy Policy is found by a competent tribunal to be invalid or unenforceable, such provision shall be severed to the extent necessary for the remainder to be valid and enforceable.
